Weekly Legislative Report (For the week of May 25, 2026 – May 29, 2026)

As the first-ever Korean law firm to issue specialized legislative journals, D&A LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report provides analyses of plenary sessions of the National Assembly, as well as standing committee and subcommittee meetings. In addition, the firm has been co-hosting the Future Leaders Forum with the Herald Business, inviting chairpersons of standing committees to discuss relevant legislative issues and tasks. 
 
As an extension of this service, D&A has also been issuing the Weekly Legislative Report, which covers various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major daily news outlets. The report will be released with an update on newly proposed or pending bills. Enclosed is this week’s legislative report. Please refer to the P&B Report for further details.

1. Proposed Bill(s)

① Partial Amendment to the Telecommunications Business Act 

This Amendment requires mobile operating system (OS) providers such as Apple and Google to provide competing services with equal access to smartphone hardware and software functionalities. 

② Partial Amendment to the Telecommunications Business Act 

This Amendment adds “creating or operating user environments that may interfere with or distort users’ decision-making” to the scope of prohibited acts under the Telecommunications Business Act, thereby establishing a legal basis for the Korea Media and Communications Commission to oversee and regulate dark pattern practices, and implement user protection measures. 

2. Pending Bill(s)

③ Partial Amendment to the Distribution Industry Development Act 

This Amendment allows superstores and quasi-superstores to provide online delivery services regardless of the existing mandatory closure and operating-hour restrictions. 

3. Promulgated Bill(s)

④ Telecommunications Business Act  

This Bill prohibits the manufacture, importation, distribution, sale, and rental of caller ID spoofing devices, requires mobile carriers to provide a subscription restriction service to all users, and expands the scope of major shareholders subject to approval to include persons who involuntarily become the largest shareholder of a facilities-based telecommunications service provider. 


4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤ Partial Amendment to the Enforcement Decree of the Framework Act on the Development of Artificial Intelligence and the Creation of a Foundation for Trust

This Amendment (i) reflects in the law the reorganization of the Presidential Council on National Artificial Intelligence Strategy; (ii) promotes the adoption and utilization of AI in the public sector; (iii) establishes a legal basis for the establishment and operation of AI research institutes; (iv) provides a legal basis for ensuring accessibility to AI and subsidizing AI usage costs for AI-vulnerable groups; (v) supports the promotion of business startups in the AI sector; (vi) provides support to AI-specialized personnel; (vii) establishes a legal basis for the provision of public data as training data for AI; and (viii) supports education and training for the utilization of AI technologies.
