Weekly Legislative Report (For the week of February 24, 2025 – February 28, 2025)

As the first-ever Korean law firm to issue specialized legislative journals, DR & AJU LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report provides analyses of plenary sessions of the National Assembly, as well as standing committee and subcommittee meetings. In addition, the firm has been co-hosting the Future Leaders Forum with the Herald Business, inviting chairpersons of standing committees to discuss relevant legislative issues and tasks.
 
As an extension of this service, DR & AJU has also been issuing the Weekly Legislative Report, which covers various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major daily news outlets. The report will be released with an update on newly proposed or pending bills. Enclosed is this week’s legislative report, and please refer to the P&B Report for further details.

1. Proposed Bill(s)
 
① Partial Amendment to the Trade Union and Labor Relations Adjustment Act 
 
This Amendment prohibits management from seeking damages from workers for losses incurred due to a refusal to work during strikes.
 
② Partial Amendment to the Telecommunications Business Act

This Amendment requires an individual who involuntarily becomes the largest shareholder of a mobile carrier to undergo a governmental review. It also allows for the imposition of additional conditions during the public interest test.

③ Partial Amendment to the Commercial Act 

This Amendment changes the subject of directors' duty of loyalty from "the company" to "the company and its shareholders." It also introduces provisions specifying that "directors shall protect the interests of all shareholders when performing their duties and fairly treat the interests of every shareholder."
 
3. Promulgated Bill(s)
 
④ Rules on Safety of Drugs, etc.  
 
This Bill specifies drugs subject to data protection and information to be disclosed upon enforcement of the data protection system, defines drugs subject to the risk management, improves the methods of establishing and filing the risk management plan, and establishes legal grounds for an en-bloc application for modifications of marketing approval (registration) of drugs according to an application for a change in business.

4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤ Partial Amendment to the Enforcement Decree of the Act on the Promotion of Saving and Recycling of Resources

This Amendment requires PET (polyethylene terephthalate) raw material producers as well as plastic bottle manufacturers to use the waste plastic recycled raw materials up to a specified ratio in a mandatory manner.
