Weekly Legislative Report (For the week of November 3, 2025 – November 7, 2025)

As the first-ever Korean law firm to issue specialized legislative journals, D&A LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report provides analyses of plenary sessions of the National Assembly, as well as standing committee and subcommittee meetings. In addition, the firm has been co-hosting the Future Leaders Forum with the Herald Business, inviting chairpersons of standing committees to discuss relevant legislative issues and tasks.
 
As an extension of this service, D&A has also been issuing the Weekly Legislative Report, which covers various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major daily news outlets. The report will be released with an update on newly proposed or pending bills. Enclosed is this week’s legislative report, and please refer to the P&B Report for further details.

1. Proposed Bill(s)
 
① Partial Amendment to the Personal Information Protection Act
 
This Amendment allows the imposition of charges for compelling compliance on a personal information controller failing to submit materials necessary to verify legal violations, at a rate of 3/1000 of the average daily sales, or up to KRW 2 million per day when such calculation is not possible.
 
② Partial Amendment to the Special Act on the Expansion of the National Power Grid

This Amendment introduces the Build-Transfer (BT) method, under which private business entities handle project implementation, including obtaining necessary authorizations and permits for power grid development, construction, and resident compensation, and transfer the constructed facilities to the Korea Electric Power Corporation (KEPCO) immediately upon completion for operation.

③ Partial Amendment to the Commercial Act

This Amendment mandates the cancellation of treasury shares within one year from the date of acquisition, while allowing up to two years for cancellation where the proportion of treasury shares is less than three percent of the total issued shares.

④ Trucking Transport Business Act
 
This Bill temporarily reintroduces the safe trucking freight rates system for a three-year period from January 1, 2026 to December 31, 2028.

4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤ Partial Amendment to the Enforcement Decree of the Passenger Transport Service Act

This Amendment extends the permissible service life of medium- and large-sized passenger cars used for rental services from five to seven years and from eight to nine years, respectively. It also sets service life of eco-friendly vehicles, such as electric and hydrogen cars, at nine years.
